Defending employment tribunal claims can prove time consuming for employers. In addition to attending any tribunal hearing, you have to spend time collating relevant documents and preparing witness statements.  All of this results in a cost to your business.

On that basis we always recommend that you take legal advice before deciding to take action that might result in a tribunal claim. Simply failing to follow a procedure can result in a claim being successful, even where you have a good reason for dismissing the individual.  Even when advice is taken it isn’t always possible to avoid tribunal claims.

We have helped employers defeat all types of claims including unfair dismissal, wrongful dismissal, disability discrimination, sex discrimination, age discrimination, race/religious discrimination, pregnancy related discrimination, whistleblowing and TUPE-related claims.

We aim to make the process of defending tribunal claims as painless as possible by carrying out the majority of the work for you. Our expert solicitors are able to assist you at every stage of the process including:

  • assessing the strengths and weaknesses of your defence;
  • explaining the law in an understandable manner;
  • setting out the commercial considerations;
  • conducting discussions with ACAS prior to a claim being formally submitted;
  • negotiating/attempting settlements via ACAS or directly with the claimant;
  • reviewing the claim and drafting your response;
  • attending any preliminary tribunal hearings to determine timescales for tasks to be completed;
  • ensuring that you include all relevant documents in the tribunal bundle;
  • drafting witness statements; and
  • conducting the advocacy at the tribunal hearing.
