Trusts can be an effective and tax efficient way to protect wealth and plan for the future. As such, they are often used in conjunction with pre-marital agreements to try and limit as far as possible the scope of claims by an estranged partner on divorce. However, given their very nature in shielding wealth, trusts often come under close scrutiny on divorce.
The existence of trusts adds a layer of complexity to a case. Specialist family law advice is needed and we work with trustees, beneficiaries and their spouses/partners to explore the impact of trusts and how they should be approached in the particular circumstances of a case.
Many of our cases involve trust interests or wider issues of inheritance and estate planning. We provide an holistic service by drawing on the expertise of colleagues in our Trusts, Wills and Estates team, to provide advice about trusts, wills and estate planning, in conjunction with our family law advice.
